1. Who We Are

This website and the products sold on it are operated by Chiropedic Bedding Pty Ltd (ABN 86 052 960 808) ("we", "us", "our").

Chiropedic Bedding Pty Ltd is part of Sleep Collective, a group of mattress and bedding brands that includes Chiropedic, Eco Kids, Yinahla, Sleep Firm, Mattress Factory Direct, House of Sleep, Sanctum and Sleep Republic.

These Terms & Conditions ("Terms") apply to your use of our website and to any purchase of products or services from us online, in‑store or by phone.

By accessing our website, placing an order or otherwise dealing with us, you agree to be bound by these Terms. If you do not agree, you must not use this website or purchase products from us.

2. Changes to These Terms

We may update these Terms from time to time by publishing a new version on this website.

The version of the Terms that applies to your order is the version in force at the time you place your order. You should check the Terms each time you visit the website or place an order to ensure you understand the current version.

3. Website Use

We grant you a limited, non‑exclusive, revocable licence to access and use this website for your personal, non‑commercial use in accordance with these Terms.

All content on this website, including text, images, graphics, logos, icons, product descriptions, audio and video clips and software, is owned or licensed by us and is protected by intellectual property laws.

You must not, without our prior written permission:

·       modify, copy, reproduce, republish, upload, post, transmit or distribute any website content;

·       use any data mining, robots or similar data‑gathering tools; or

·       use any content for commercial purposes.

You must not misuse this website, including by introducing viruses or other malicious code, attempting to gain unauthorised access to our systems, interfering with the security or operation of the website, or using the website for any unlawful purpose.

We do not guarantee that the website will be available at all times or that it will be free from errors or interruptions. We may suspend, withdraw or restrict the availability of all or any part of the website for business or operational reasons.

4. Accounts

We may allow you to create an account on our website. You are responsible for keeping your account details and password confidential and for all activity that occurs under your account.

You must notify us promptly if you become aware of any unauthorised access to, or use of, your account.

We may suspend or cancel your account at any time if we reasonably believe you have breached these Terms or misused the website.

5. Products, Pricing and Payment

Product descriptions, images and other information on our website are provided for general information only. While we aim to ensure they are accurate, they may contain errors, inaccuracies or omissions.

All prices are in Australian dollars (AUD). Unless stated otherwise, prices are inclusive of GST.

We may change our prices at any time. Changes will not affect orders we have already accepted.

From time to time we may run promotions, sales or offers with special pricing or benefits. Additional terms may apply and will be notified with the offer.

You must pay for your order in full at the time of placing the order using one of the payment methods made available at checkout. By providing payment details, you authorise us (or our third‑party payment provider) to charge the relevant amount to your chosen payment method.

If your payment is declined, or we reasonably suspect fraud, unauthorised use or other suspicious activity, we may cancel your order or require additional verification before accepting it.

6. Orders and Contract Formation

You must be at least 18 years old and capable of entering into a legally binding contract to place an order with us.

By placing an order, you make an offer to purchase the products in your order in accordance with these Terms.

We may accept or reject your order for any reasonable reason, including unavailability of stock, a pricing or description error, or concerns about your payment or delivery address.

If we accept your order, we will send you an order confirmation email. A binding contract is formed when we send that confirmation.

If we are unable to accept your order, we will notify you and, if your payment has already been processed, we will refund the amount paid using your original payment method.

7. Delivery, Risk and Title

We deliver products to the locations in Australia shown on our website or notified at checkout. Some remote or regional locations may be excluded or may attract additional charges.

Delivery fees (if any) and estimated delivery timeframes will be displayed at checkout. Any delivery timeframes are estimates only and are not guaranteed.

You must provide a correct delivery address and contact details. If you provide an incorrect address, or an address where delivery is not possible, you may be responsible for additional delivery fees or costs of redelivery.

Risk in the products passes to you when they are delivered to the delivery address you nominate, or to your authorised representative, or when they are left at the location you authorise us or our carrier to leave them.

If you authorise us or our carrier to leave the products unattended at your delivery address, you accept all risk for theft, loss or damage from the time they are left at that location.

Title to the products passes to you when we receive full payment of the purchase price and any applicable delivery charges.

8. Trial Period / Comfort Guarantee

Some of our brands offer a trial period or comfort guarantee on certain products (for example, a 150‑night trial on mattresses). The specific terms of any trial or comfort guarantee are set out on the relevant product or brand page and form part of these Terms.

Unless stated otherwise, trial or comfort guarantees:

·       are only available for eligible products purchased for personal, domestic use in Australia;

·       are limited to one trial per household or delivery address; and

·       are available to the original purchaser only.

To request a return under a trial or comfort guarantee, you must contact us within the specified trial period and follow our instructions. We may require proof of purchase and photographs of the product and its condition.

The product must be in a as new condition (for example, no tears, rips, damage, mold, marks or stains) and must have been used on an appropriate base or support, as recommended for the product.

We may arrange collection of the product from your address or ask you to drop it off at a collection point, depending on your location. In some circumstances, a collection or return fee may apply; any such fee will be disclosed in the relevant brand's trial terms.

If your return is approved under the trial or comfort guarantee, we will provide a refund or other remedy as described in the brand's trial terms. Refunds will usually be made using your original payment method and within a reasonable time after we receive the returned product or proof that it has been collected.

9. Change of Mind Returns

Apart from any trial or comfort guarantee, we may offer a separate change‑of‑mind returns policy for certain products, as set out on the relevant website or product page.

Any change‑of‑mind returns policy is subject to conditions (for example, time limits, that products are unused and in original packaging, and exclusions for pillows or other hygiene‑sensitive products).

Nothing in any change‑of‑mind policy limits your rights under the Australian Consumer Law.

10. Australian Consumer Law and Faulty Products

Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

If you believe a product has a fault, is not of acceptable quality, or has been damaged in transit, please contact us as soon as possible with details and supporting photographs.

We may require you to return the product for assessment or inspection. If the product is found to have a fault, we will provide a remedy in accordance with the ACL, which may include repair, replacement or refund.

If the product is found not to have a fault, or the issue is caused by misuse, abnormal use, or failure to follow care instructions, we may decline to provide a remedy and you may be responsible for costs of inspection and return.

11. Warranties

In addition to your rights under the ACL, we may offer a manufacturer's warranty on certain products for a specified period (for example, 20 years for mattresses, different periods for other products). The details of any manufacturer's warranty, including what it covers and how long it lasts, are set out in the warranty information relevant to that product.

Manufacturer's warranties generally cover defects in materials and workmanship when products are used in normal domestic conditions and in accordance with our care and usage instructions.

Manufacturer's warranties do not usually cover:

·       normal wear and tear or gradual softening;

·       minor manufacturing variations or cosmetic imperfections that do not affect performance;

·       damage caused by misuse, abuse, neglect, improper storage, inadequate base or support, or failure to rotate or care for the product as recommended;

·       stains, soiling, burns, cuts, tears, mold, odours or damage caused by liquids or pets; or

·       use in commercial or non‑domestic environments unless expressly stated.

To make a claim under a manufacturer's warranty, you must contact us with proof of purchase and details of the issue (including photographs). We may ask you to return the product or a sample for inspection.

If we determine that the issue is covered by the manufacturer's warranty, we will provide the remedy described in the warranty (for example, repair, replacement of all or part of the product, or other appropriate remedy). The warranty period does not restart when a product is repaired or replaced.

12. Promotions, Discounts and Gift Cards

From time to time we may offer promotions, discount codes, bundles or other special offers. Each promotion is subject to these Terms and any additional terms we publish with the offer.

Unless stated otherwise:

·       promotions and discount codes are available for a limited time only;

·       a promotion or discount code cannot be used in conjunction with any other promotion or discount;

·       only one discount code can be used per order;

·       promotions and discount codes are not transferable or redeemable for cash; and

·       we may withdraw or vary a promotion at any time, except in relation to orders we have already accepted.

Gift cards or vouchers (if offered) are subject to the terms and expiry period stated at the time of issue and are not redeemable for cash (except where required by law).

13. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the ACL or any other applicable law that cannot be excluded, restricted or modified.

To the extent permitted by law, our liability for a breach of a non‑excludable guarantee, condition or warranty is limited, at our option, to one or more of the following:

·       in the case of goods – the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; and

·       in the case of services – the supply of the services again, or the payment of the cost of having the services supplied again.

To the extent permitted by law, we are not liable for any loss or damage that is indirect, consequential or special in nature, including loss of profit, loss of revenue, loss of opportunity or loss of data.

We are not responsible for any delay or failure to perform our obligations under these Terms if such delay or failure is due to an event beyond our reasonable control (see clause 16).

14. Indemnity

You agree to indemnify us and hold us harmless from and against any loss, damage, claim, cost or expense (including reasonable legal fees) arising out of or in connection with your misuse of the website, your breach of these Terms, or your violation of any law or the rights of a third party, except to the extent caused or contributed to by our negligence or breach of these Terms.

15. Privacy

We collect, use and disclose personal information in accordance with our Privacy Policy, which forms part of these Terms.

By using the website or purchasing products from us, you consent to our handling of your personal information as described in the Privacy Policy.

16. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is due to any cause beyond our reasonable control, including acts of God, war, strikes, labour disputes, breakdown of plant or machinery, pandemic, government restrictions, transport or supply disruptions, or other similar events.

If a force majeure event occurs, we will take reasonable steps to minimise its impact on our services and will resume performance as soon as reasonably practicable.

17. Governing Law and Disputes

These Terms are governed by the laws of Victoria, Australia.

You and we submit to the exclusive jurisdiction of the courts of Victoria and the courts of appeal from them in respect of any proceedings arising out of or in connection with these Terms or your use of the website.
